Hi everyone.  I wanted to post this as I believe this NCPAC election is extremely important.  Below is an email from Peter Gallo to our NCPAC board one of the people that are running for President's remarks regarding us, the appraisers.  If you didn't get this email, I believe you will be shocked at his response and can see why I feel so strongly about some changes.   We just can't have this type of mindset while representing us. Peter, myself, and David Cozzarelli were all adamant that we needed some guidance or help from NCPAC.  As you all know to well we all stand on these islands facing these giant AMC's and NCPAC could be the vehicle to bring us all to one Island but not with this type of attitude.  Please read carefully and consider who you vote for.  Peter's email is first at the bottom and then David DesChamps email is the response.

I appreciate and respect your efforts to inform appraisers of valuable information, however, to suggest that NCPAC as an organization need to publish “guidance” or an “official stance” with regard to one AMC and/or their business practices wreaks with hypocrisy as many NCPAC members currently sign such agreements and work for AMCs such as the one in question.  NCPAC as an organization, and most of its current Board and Officers have worked diligently over the years to help appraisers to stand on their own two feet, grow a backbone, and treat their profession in a businesslike manner.  If those who continue to sign these type of agreements, or work for AMCS which treat them like this, need guidance from someone else as to whether or not to sign such a ludicrous agreement, then they need more help than NCPAC can offer!

 

In Senate Bill 829, paragraph 93E-2-7 Prohibited acts, it clearly states that an AMC cannot require an appraiser to indemnify them.  As such, a better approach would be for all of the appraisers who work for this AMC to file a formal complaint for its business practices, which are clearly in violation of the law.  $10,000 per violation would be a move in the right direction.  As you know, NCPAC worked diligently for the ratification of this Bill…and it is now law!  As long as individual appraisers are going to allow this type of abuse by AMCs to continue {by signing such agreements and working for them}, then the AMCs will continue.  This is a problem with appraisers, not a problem with NCPAC!

 

I have spoken to several Board members and Officers, and an NCPAC Board meeting is tentatively going to be scheduled for Monday, May 9, 2011, in Raleigh.  I would encourage you and any other members to attend and share your thoughts on how NCPAC as an organization can better serve its membership.  It is my personal belief that it is time for the membership to stand up and be accountable for themselves, to fully take advantage of the laws which are in place, and to stop selling this profession down the river as they have been doing.

Regarding the Landsafe agreement…I have received many emails from appraisers on this.  What advice/action can I tell them that NCPAC has for them?

 

I would like to give them an “official” stance or at least advise them of what NCPAC is doing about this?

 

At this point I have posted Lauriette’s comments (with her permission) and have also advised members not to sign the agreement.

 

Will there be a letter from the president or some other guidance?  Many appraisers feel that they have no choice but to sign this.
